When the Court Can Step In
Another very important protection for foreigners in Saudi Arabia is the court’s role when a guardian is absent, cannot be reached, or prevents a marriage without proper reason. The law sets an order for guardians in marriage and explains that the guardian should be an adult, mentally sound male who agrees with the woman in religion. But the law does not leave the matter there. If the guardian’s attendance is not possible, or if notification is not possible, the court can transfer guardianship to the next guardian.
If the guardian blocks the marriage of a woman to someone suitable whom she accepts, the court may take over and arrange the marriage or authorize someone to conduct it according to the legal rules. For foreigners, this is a valuable point because it shows that the law includes a legal path when family process becomes difficult or unfair. It also means that marriage issues do not always end when family agreement breaks down. In some cases, the court can protect the person’s legal interest and help move the matter forward in an organized and lawful way.
